Terms of Service

1. Acceptance of Terms

By accessing or using eCRM at email-crm.app, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the service. You must be at least 18 and, if you use eCRM for a company, authorised to accept these terms on its behalf.

2. Description of Service

eCRM is a cloud-based email outreach and CRM platform that allows users to manage leads, create campaigns, and send emails via connected sender accounts (Gmail, Outlook, SMTP).

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorised access.

One account per person. You may not share account credentials with others.

You are solely responsible for ensuring your email campaigns comply with all applicable laws including CAN-SPAM (USA), GDPR (EU), and CASL (Canada). You must include an unsubscribe mechanism in all marketing emails, honour opt-out requests promptly, and have a lawful basis for emailing every contact you upload.

You are responsible for the mailboxes you connect and must have the right to authorise eCRM to send from and read replies in them. Your use of Gmail or Outlook through eCRM must also comply with Google's and Microsoft's terms. We may pause campaigns or sender accounts that show signs of abuse, such as high bounce or complaint rates.

6. Email Warmup

If you enrol a mailbox in warmup, you authorise eCRM to send automatically generated emails between that mailbox and other mailboxes in the eCRM warmup network, to reply to warmup emails, and to move warmup emails out of spam. Your mailbox will receive warmup emails from other participants. Warmup improves sender reputation over time but we do not guarantee inbox placement. You can leave warmup at any time.

7. Payment & Billing

Paid plans are billed monthly. All fees are non-refundable unless required by law. We reserve the right to change pricing with 30 days notice. Failure to pay may result in account suspension.

8. Data Ownership

You retain ownership of all data you upload to eCRM. By using the service, you grant us a limited licence to process that data solely to provide the service.

9. Service Availability

We aim for high availability but do not guarantee uninterrupted service. We are not liable for damages resulting from downtime, data loss, or service interruptions.

10. Termination

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice. You may cancel your account at any time. Upon termination, your data will be deleted within 30 days.

11. Limitation of Liability

eCRM is provided "as is". To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amount paid by you in the 3 months preceding the claim.

12. Changes to Terms

We may update these terms at any time. Continued use of the service after changes constitutes acceptance of the new terms.

13. Governing Law

These terms are governed by the laws of India, without regard to conflict-of-law rules. The courts of India have exclusive jurisdiction over any dispute arising from these terms or your use of eCRM, unless mandatory consumer protection law where you live says otherwise.
